Terms of Use
Last updated 23 October 2026
These terms are an agreement between you and Vekgard Pty Ltd (ACN 702 938 547) ("we", "us"), which runs PaceMate. By creating an account or using PaceMate you agree to them.
Please read them, especially the sections on risk and liability.
Who can use PaceMate
You must be 18 or older. You may only have one account, the details you give us must be true, and you are responsible for keeping your login secure and for everything done with your account.
What PaceMate is, and is not
PaceMate is a platform that lets members post and join group runs, swims and rides organised by other members.
We do not organise, lead, supervise, inspect or insure any session. Hosts and participants are independent members, not our employees, coaches, agents or partners.
We do not carry out identity or background checks on members, and we do not check that session details such as distance, pace, route, meeting point or conditions are accurate, safe or suitable for you.
Risk warning
Running, cycling and swimming are physical recreational activities with real and obvious risks, including injury, illness, falls, collisions with vehicles or other people, hazards in water, on roads and trails, heat and weather, and in rare cases serious injury or death.
Meeting people you do not know also carries risk.
You take part in any session entirely at your own risk. You decide for yourself whether a session, route, pace, distance and the conditions on the day are right for you, and you can leave at any time. If you have any doubt about your health or fitness, speak to a doctor first.
Follow the law at all times, including road rules, and follow beach, pool and venue safety rules and directions.
By joining or hosting a session you confirm that you understand these risks, that you are fit and able to take part, and that you accept the risks as your own.
Information in the app
Paces, distances, routes, meeting points, maps, weather, pace matching and anything else shown in PaceMate come from members or from automated services. They are a guide only and may be wrong or out of date. Check the conditions and make your own decision on the day.
We use automated checks and member reports to help keep PaceMate safe, including checks on photos. These do not catch everything, and we do not promise to review, monitor or remove any content, profile or session.
Other members
Your dealings with other members, at a session or anywhere else, are between you and them. We are not a party to them and we are not responsible for what any member says or does, in the app or in person.
Hosting a session
If you host, you must describe your session honestly and accurately, choose a public meeting point, and cancel promptly if plans change.
Hosting does not make you our representative. You are responsible for the decisions you make as a host.
Coaches, clubs and businesses must not use PaceMate to promote or sell paid services without our written permission.
Your content
You own what you post. You give us a worldwide, royalty-free licence to store, display and use it to run and improve PaceMate.
You agree that we may collect, hold and use the information you give us as described in our Privacy Policy. You can delete your account, and with it your information, at any time.
You are responsible for what you post, and you must not post anything that is illegal, harmful, misleading, or that breaks our Community Guidelines or someone else's rights.
Only upload photos you have the right to share. If other people are in a photo, make sure they are happy for it to be shown. Photos are checked automatically and we may remove any photo.
Rules
Do not harass, threaten, abuse, discriminate against or impersonate anyone. Do not post sexual content, spam or advertising. Do not try to access other people's accounts or information, copy or scrape the service, or interfere with how it works.
You must follow our Community Guidelines, which form part of these terms.
Moderation and closing accounts
We may remove content, limit features, or suspend or close any account at our discretion, including to protect members' safety, without notice. We may share information with police or authorities where we believe it is necessary or required by law.
You can delete your account at any time in Profile and settings.
No guarantees
PaceMate is provided "as is". We do not promise that sessions will go ahead, that members will turn up or behave well, that information in the app is accurate, or that the app will always be available or free of errors.
Our liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Subject to that, and to the fullest extent permitted by law: (a) we are not liable for any death, personal injury, illness, loss or damage arising from any session, from your dealings with other members, or from other members' conduct; (b) we are not liable for any indirect or consequential loss; and (c) where our liability cannot be excluded but can be limited, it is limited, at our choice, to supplying the service again or paying the cost of having it supplied again.
To the fullest extent permitted by law, you release us, and our directors, staff and contractors, from all claims arising out of sessions or disputes between you and other members, and you agree not to bring any such claim against us.
We don't charge you to use PaceMate. To the fullest extent permitted by law, if we are ever liable to you for anything else, our total liability for all claims of any kind, including claims about how we handle your information, is limited to AUD $10.
Indemnity
To the extent permitted by law, you agree to cover us for any claim, loss or cost arising from your breach of these terms, your content, or your conduct at or in connection with any session.
Changes, law and contact
We may change, pause or stop any part of PaceMate at any time.
We may update these terms. If we make a significant change, we will tell you in the app, and continuing to use PaceMate means you accept the updated terms.
If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. These terms, with our Privacy Policy and Community Guidelines, are the whole agreement between you and us about PaceMate. We may transfer our rights under these terms to another company that takes over PaceMate.
These terms are governed by the law of New South Wales, Australia, and you submit to the courts of that state.
